User Generated Content Terms & Conditions

We are always excited to see, receive and share photos, videos and other forms of content* (“Content”) of Lay-Z-Spa products being used and enjoyed. 

Tagging the brand, hashtags, mentions and messages on social media

We appreciated being tagged and mentioned in content on social media channels. We often share that content as a story and, on occasion, we will re‑post content from within the Lay-Z-Spa community without specific consent but will always endeavour to credit or attribute the content to the profile from which it was posted.

Invitation to be a collaborator on a post

By inviting Lay-Z-Spa to be a collaborator of a post on Instagram, you are automatically permitting us to use your content, as highlighted in the section below. 

Request to use your content

If we have commented on your post, sent you a message, are working on a collaboration or provided a written agreement, requesting your permission to use your content, please review the terms and conditions below. If you agree, please respond to our request accordingly to indicate you consent to us using the content through any of the Lay-Z-Spa & Bestway channels (“Channels”)**.

By agreeing to let us use your Content, you:

  • Grant us (where "us" means and refers to Lay-Z-Spa and its affiliates) the unrestricted, irrevocable, perpetual, worldwide and royalty-free, non-exclusive transferable right to use, reproduce, repost, adapt, publish, display, broadcast, publicly perform, modify and otherwise distribute the Content, and all intellectual property rights through our channels.

  • Agree that if Content is selected for use by Lay-Z-Spa UK, we may use your full name, social media handle / username(s), and the city or region of your residence and/or operation for the purpose of identifying, promoting and/or generating publicity for the usage of the Content.

  • Agree that: (a) you are the sole creator, own all rights to, or have paid for or otherwise have the right to grant Lay-Z-Spa UK the rights described above to the Content; (b) you are at least 18 years of age; (c) your and Lay-Z-Spa UK’s use of the Content will not infringe on the rights of any third parties; and (d) you have obtained permission from all persons whose name, voice, image, likeness and/or any other identifiable representation are included in the Content, including parents or guardians of any children featured.

  • Understand that sending or posting the Content through or on the Lay-Z-Spa UK Channels does not mean that we have to use it; but if we do, you waive any potential claims against us with respect to any use of the Content or Your Likeness.

  • You continue to retain all ownership rights you hold in your Content, and you retain any right to use your Content in any way you choose. You represent and warrant that Lay-Z-Spa UK’s displaying, publishing or posting of the Content, and our use thereof does not and will not violate the data protection and privacy rights, publicity rights, copyrights, performers' rights, trademark rights, patents, contract rights or any other intellectual property rights or other rights of any person or entity.

  • If your content contains an endorsement or testimonial of our products or services, you further agree that it is a true and accurate expression of your honest belief based on use of Lay-Z-Spa UK products and that you have disclosed receipt of any free product or incentives in exchange for providing Your Post.

Use and retention of user-generated content

When you provide us with photos, videos, or quotes (including quotes taken from videos), we process this content with your explicit consent for use in our marketing materials. This may include, but is not limited to, social media posts, email campaigns, blog content, and other promotional channels.

We retain this content for as long as it is required to support our ongoing marketing activities, or until you withdraw your consent. Because our marketing materials may be published or reused over extended periods, the content may be stored and used on a continuing basis.

If you withdraw your consent, we will stop using your content in future materials and will remove it from our active marketing assets where reasonably possible. Content already published before withdrawal may remain available in existing materials (for example, historic social media posts or blog content).

You may withdraw your consent at any time by contacting us, and doing so will not affect the lawfulness of any use prior to your withdrawal.

Photo sharing competitions

By entering any of our photo competitions on social media, you are granting us rights to use your content in accordance to the points above, regardless of whether you are selected as winner.

*Content is defined as photos, videos, comments, content, illustrations, or information relating to the Content (“Content”).

**Channels are defined as our social media channels (where "our" means and refers to Lay-Z-Spa and its affiliates), e‑commerce websites, digital advertising, and/or print advertising campaigns.
